Technology
Parties are expected to prepare for the remote proceeding by obtaining the necessary equipment and software well before the proceeding begins. Whenever possible, participants should use computers, laptops, or tablets, not mobile phones, to attend a remote proceeding. Participants must ensure that their bandwidth is adequate for video conferencing and should use a reliable LAN, WiFi, or LTE Mobile connection. (Note: Cabled network connections are preferred. Mobile data use may incur cellular carrier charges which are the responsibility of the remote participant.)
Parties are responsible for their own technology and must become familiar with Zoom’s controls before the remote proceeding. The parties must also test their device’s video, microphone, and speaker controls to ensure compatibility with the Zoom platform. The Office of the Presiding Disciplinary Judge CANNOT provide support or assistance prior to or during the remote proceeding. Attending the Remote Proceeding
Parties must join the proceeding at least ten minutes before the scheduled start time. All participants must configure their names to display correctly. The PDJ will confirm with the parties that all necessary participants are present and that they can see and hear the proceeding.
The proceeding will then go forward as though the parties were physically present, subject to any rules specifically adopted for remote proceedings.
Technical Problems Interrupting the Remote Proceeding
If a participant is disconnected from the remote proceeding, the PDJ will briefly pause the proceeding to allow the participant to rejoin. If a disconnected participant cannot promptly reconnect to the remote proceeding, the participant must immediately dial in to the proceeding using the dial-in number above.
If the PDJ determines at any time that the audio or video connection is so poor as to interfere with the fair administration of justice, the PDJ will briefly pause the remote proceeding to establish a better connection. If a better connection cannot be established or there are other ongoing technical problems caused by no fault of the parties, the PDJ generally will continue the proceeding until the issue can be cured or other arrangements can be made.
Each party or party’s counsel is responsible for immediately contacting the PDJ’s administrator by email and telephone if a technological disruption had substantially interfered with the ability to see or hear what is occurring during the remote proceeding.
Decorum
A remote proceeding is a court proceeding and therefore an extension of the courtroom; appropriate professional conduct, attire, and camera background are required at all times. The PDJ has the same authority over the proceeding and the participants as if they were physically present in the courtroom. Participants are expected to behave with the same levels of courtesy and professionalism as at an in-person proceeding.
As in an in-person proceeding, participants should speak one at a time. Participants must use the mute feature when not speaking in order to avoid any potential background noise, and should disable audio notifications from other applications on their own devices. Participants must always have their video cameras enabled. Participants may not use the chat feature of Zoom except to notify the PDJ's staff that the participants are experiencing technical problems.
Participants must use a private and quiet indoor room that will be free of interruptions. Participants should place devices on a solid surface with the camera at eye level or slightly above eye level. Do not hold or carry devices and do not lay devices flat on a desk or tabletop.
Participants should be mindful of their surroundings and verify that their background is appropriate before joining the remote proceeding. Attending a remote proceeding while outdoors, in a vehicle, or in a public place is not permitted. Choose a solid, neutral background if possible, and check the lighting to ensure that the camera does not face a window, which can blind the camera and make the Zoom image look dark.
Recording
Neither participants nor observers may record or reproduce Court proceedings. Any recording of Court proceedings—including any audio recording, visual recording, screen capture, or photograph—without the express prior written authorization of the Court is prohibited and may subject the recording party to contempt proceedings, including a fine, jail, or both. See Colorado Supreme Court Chief Justice Directives 23-02 and 23-03 as well as C.R.S. § 13-1-132.
Observing a Remote Proceeding
Observers of remote proceedings are responsible for their own technology and must become familiar with Zoom’s controls before the proceeding begins. The PDJ’s staff cannot provide technical support or assistance before or during any remote proceeding.
Please note that observers of remote proceedings are under the PDJ’s authority as if present in the courtroom. The PDJ may instruct an observer who disrupts the remote proceeding to leave the Zoom session; failure to comply with the PDJ’s instructions will result in the observer’s removal.
Observers must disable the video function on their devices. Observers must remain muted at all times during the remote proceeding. Observers may not use the chat function for any reason.
Please note that remote proceedings conducted confidentially by court order or rule are not open to the public.
